Terms and Conditions of Use Corporate Pass Participants

By clicking on the "I Accept the Terms and Conditions of Use" button when you register for our MBTA Corporate Pass Program, you represent that: (i) you are an authorized representative of your employer, (ii) that you understand and accept the terms and conditions of this Agreement; and (iii) that you understand and accept the MBTA's Terms and Conditions (available at Dec, 2006). This Agreement applies to your use of the Corporate Pass Program to acquire transit fare from the Massachusetts Bay Transportation Authority (“MBTA”). This Agreement affects your rights and you should read it carefully. You will not be able to use the Service unless you consent to this Agreement.

  • 1.   AGREEMENT BETWEEN CORPORATE USER AND MBTA
    The MBTA Corporate Pass Program Web Site is comprised of various Web pages operated by the Massachusetts Bay Transit Authority (“MBTA”), as a component of the general MBTA website located at www.mbta.com. The services available on our Corporate Pass Program Site (the "Service") are offered to commercial and government entities under the terms and conditions contained herein, without modification. As an authorized representative of a commercial or government agency, your use of our Corporate Pass Program Site constitutes your and your employer’s agreement to all such terms and conditions.
  • 2.   AUTHORITY TO ACT ON BEHALF OF EMPLOYER
    You represent and warrant that you have authority to act on behalf of your employer in registering for our Corporate Pass Program, and in acting on behalf of your employer with respect to these Services. In this Agreement, the term "you" and "your" means (i) any person managing the Program on behalf of his or her employer, and (ii) the employer itself.
  • 3.   THIRD PARTY ADMINISTRATORS
    You may elect to have a Third Party Administrator represent you, and the MBTA will treat any Third Party Administrator as you for the purposes of this Agreement. Please be sure your Third Party Administrator uses due care in representing you, as any mistakes or errors made by your Third Party Administrator will be treated as mistakes or errors made by you.
  • 4.   PASSWORDS
    When you register for the Corporate Pass Program, we will provide you with a confidential password. Please keep in mind that we will treat anyone who uses your password as "you," the authorized representative of your employer. We will provide this user with all of the rights and privileges that we provide to you, and we will hold you responsible for the activities of a person using your password. Therefore, we recommend that you maintain your password in confidence, and that you refrain from disclosing this information to anyone who might "pretend" to be you with respect to our Corporate Pass Program, as this will impact your employer, whom you are representing. We also ask that you notify us immediately if you suspect that someone is using your password in this manner.
  • 5.   FORM OF PAYMENT
    Participants are required to pay for fare media in advance through an automatic check handling feature (“ACH”) or wire transfer that transfers money from the participant's bank account directly to the MBTA.


      The following terms and conditions attach to the choice of ACH payment:
      • The automatic reordering features is assumed for all orders
      • Orders must be completed and submitted to the Web Site before the 16th of the month preceding the month of usage
      • Orders will not be released until the funds clear the bank, which must occur before the 17th of the month preceding usage of the fare media
  • 6.   OTHER PURCHASER RESPONSIBILITIES
    • 6.1   No Multiple Accounts. You agree that you will not sign up for more than one account on the Service and that the account created is identified by the corporate employer as a properly qualified participant.
    • 6.2   No Impersonation. You agree not to impersonate any person or use a name that you are not authorized to use.
    • 6.3   User Acknowledgment. You acknowledge that (i) the Service is not a banking service (ii) the Service accounts are not insured by any government agency, that (iii) the Service is not subject to government regulations and (iv) all income earned on the Service accounts belongs to MBTA and you have no interest in any such income.
  • 7.   VALIDITY OF ELECTRONIC COMMUNICATION
    All Communications that the MBTA sends to you in electronic format will be considered to be in "writing," and that they have been received by you no later than two (2) business days after posting or dissemination, whether or not you have actually received or retrieved the Communication. We ask that you check your email regularly if you are expecting an electronic communication from the MBTA.
  • 8.   MODIFICATION OF THESE TERMS OF USE
    MBTA reserves the right to change the terms, conditions, and notices under which the Corporate Pass Program Site is offered, including but not limited to the charges associated with the use of the Corporate Pass Program Site. Any changes made to the corporateprogram.mbta.com become effective upon your subsequent consent to the Terms and Conditions of Use.
  • 9.   TERMINATION/ACCESS RESTRICTION
    MBTA reserves the right, in its sole discretion, to terminate your access to the Corporate Pass Program Site and the related services or any portion thereof at any time, without notice.
